When you enter debt review and a debt counsellor determines you are over-indebted under Section 86(6)(a) of the National Credit Act. A “debt review” flag is placed on your credit profile.
If you decide to cancel your debt review, the debt counsellor cannot remove this flag unless all your debts have been settled. However, you still have the right to approach the Magistrate’s Court to have the flag removed.
This type of application to the Court must be made before your debt restructuring proposal becomes a formal Court order under Section 86(7)(c) of the National Credit Act.

Through this process, we work to demonstrate that you are not over-indebted, requesting the Court to overturn the debt counsellors' finding and remove the debt review flag from your credit profile.
This option is only available if the administrative process and legal proceedings with your debt counsellor have not yet been finalized.
Once the Court grants the order, it is provided to your debt counsellor, who must then remove the “debt review” listing from the credit bureaus—restoring your financial freedom.

What does a rescission application for debt review involve?
A rescission application is filed at the Magistrate’s Court with jurisdiction, requesting that the existing debt review Court Order be set aside and that the consumer be declared no longer over-indebted.
This application must:
Notify the Court that the consumer was previously found over-indebted under the original Court Order (which must be attached as an annexure).
Demonstrate that the consumer’s current financial situation has improved, showing they are no longer over-indebted.
Make it clear that the consumer no longer requires debt review.
Through this process, the Court is asked to rescind (cancel) the existing debt review order, effectively removing the consumer from debt review status.for debt review involve?

No paid-up letters or complex situation? You’ll need a legal intervention, pushing costs to R5,000–6,000 (court route) or up to R8,100 for full legal service with aftercare.

Note on timing:
Certificate route: 7 - 21 days to reflect removal on credit bureaus.
Delays can occur should your debt counsellor act slow or should the credit bureaus have a backlog.
Court route: Anywhere from 30 - 90 days depending on the complexity of your application and the courts availability.
